Motorsport Fanatix™ Terms of Service

1. Acceptance of These Terms
These Terms of Service govern your access to and use of:
Motorsport Fanatix Insider™ on Beehiiv
Motorsport Fanatix™ newsletters, articles and related digital content
Any associated features, forms or services that refer to these Terms
The websites, newsletter and related content are collectively referred to as the “Services”.
By using the Services or subscribing to Motorsport Fanatix Insider™, you agree to these Terms. If you do not agree, you should not use the Services.
These Terms do not replace a separate written agreement entered into for photography, public relations, media management or another paid Motorsport Fanatix™ service. If a separate agreement conflicts with these Terms, the separate agreement will apply to that paid service.
2. About Motorsport Fanatix™
Raymond Cornwell operates Motorsport Fanatix™ in South Africa.
Motorsport Fanatix™ provides motorsport journalism, photography, editorial coverage, public-relations support, social-media content and related media services.
Motorsport Fanatix Insider™ is an email newsletter and online publication featuring South African motorsport news, race reports, driver stories, previews and related content.
3. Eligibility
The Services are intended for people who are legally capable of accepting these Terms.
Anyone under the age of 18 should use the Services or subscribe only with a parent's or legal guardian's permission and supervision.
4. Newsletter Subscriptions
You must provide an email address that you are authorised to use.
We may require you to confirm your subscription through a double opt-in email.
You may unsubscribe at any time using the link provided in each newsletter. Unsubscribing does not cancel or affect a separate paid service agreement with Motorsport Fanatix™.
We may suspend or remove a subscription where we reasonably believe that:
The address was added without permission
The subscription is fraudulent or abusive
Continued delivery presents a security or legal risk
The subscriber repeatedly interferes with the proper operation of the Services
We may change the newsletter’s format, content or publishing frequency without guaranteeing a particular delivery schedule.
5. Editorial Content and Accuracy
Motorsport Fanatix™ makes reasonable efforts to provide accurate and timely information.
Motorsport schedules, entry lists, results, regulations, livestream arrangements and championship standings may change. Information may also depend on organisers, timing providers, teams, drivers or other external sources.
We do not guarantee that every item will always be complete, current or error-free. Where a material factual error is identified, we may correct or update the relevant content.
Editorial opinions are identified as opinion or commentary where reasonably appropriate. Views expressed by quoted contributors do not necessarily represent those of Motorsport Fanatix.
6. No Professional or Safety Advice
Content is provided for general information, editorial and entertainment purposes.
It does not constitute legal, financial, medical, technical, motorsport safety or professional advice.
Motorsport is inherently dangerous. Nothing published through the Services should replace official event regulations, safety instructions, professional training or directions issued by organisers, officials, teams or governing bodies.
7. Intellectual Property
Unless otherwise stated, the Services and their original content are owned by or licensed to Motorsport Fanatix™. This includes:
Articles and reports
Photographs and video
Graphics and layouts
Logos and branding
Newsletter content
Website text
Original social-media material
You may not use “Motorsport Fanatix™”, its logos, or related brand elements in a way that suggests authorisation, partnership, or endorsement without written permission.
You may:
Read and view the content for personal, non-commercial use
Share links to publicly available Motorsport Fanatix pages
Use ordinary social-platform sharing functions
You may not, without prior written permission:
Copy or republish complete articles
Download, reproduce, sell or commercially exploit photographs
Remove watermarks, credits or copyright notices
Use content to train, populate or operate another publication, commercial database or automated service
Present Motorsport Fanatix content as your own
Use our branding to impersonate Motorsport Fanatix
Limited quotation for legitimate reporting, criticism or review may be permitted where allowed by law and accompanied by appropriate attribution.
8. User Messages and Submissions
You remain responsible for information, photographs, comments, media releases, tips or other material you submit.
By submitting material for possible publication, you confirm that:
The information is accurate to the best of your knowledge
You are authorised to provide it
Its use will not unlawfully infringe another person’s privacy, copyright or other rights
Any necessary parental, guardian, team or third-party permission has been obtained
You retain ownership of material you own. You grant Motorsport Fanatix™ a non-exclusive, worldwide, royalty-free licence to store, edit and use submitted material for the purpose for which it was supplied, including agreed editorial or promotional publication.
We may decline, edit, remove or correct submitted material. Submission does not guarantee publication.
9. Acceptable Use
You may not use the Services to:
Break any applicable law
Harass, threaten or defame another person
Upload malicious code or interfere with security
Attempt unauthorised access to an account or system
Scrape, harvest or extract subscriber or contact information
Send spam or misleading communications
Impersonate Motorsport Fanatix™ or another person
Misrepresent an affiliation, accreditation or endorsement
Infringe copyright, trademark, privacy or other rights
Use automated systems in a way that places an unreasonable burden on the Services
10. External Links and Third Parties
The Services may link to event organisers, timing platforms, livestream services, social-media platforms, sponsors, partners and other third parties.
A link does not necessarily constitute an endorsement. Motorsport Fanatix™ does not control and is not responsible for third-party content, availability, security, transactions or privacy practices.
Any transaction or interaction with a third party is between you and that third party.
Sponsored, partner, or promotional content may be identified where reasonably appropriate. Commercial relationships do not automatically determine editorial conclusions.
11. Privacy
We handle personal information according to the Motorsport Fanatix™ Privacy Policy.
By subscribing or submitting information, you acknowledge that we may process it through service providers such as Beehiiv and Squarespace, as explained in that policy.
12. Availability and Changes
We may change, suspend or discontinue any part of the Services.
We do not guarantee uninterrupted access or that the Services will be free from technical faults, harmful code or third-party interference.
Maintenance, platform outages, internet failures or circumstances outside our control may affect availability.
13. Disclaimer and Limitation of Liability
We provide the Services on an “as available” basis.
To the fullest extent permitted by applicable law, Motorsport Fanatix™ will not be liable for indirect, incidental, special or consequential loss arising from:
Reliance on editorial information
Changes to schedules, results, entries or livestreams
Service interruptions
Third-party websites or services
Unauthorised access outside our reasonable control
Decisions made based on general information published through the Services
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including rights available under applicable South African consumer-protection legislation.
14. Suspension or Termination
We may restrict or terminate access where a user breaches these Terms, interferes with the Services, infringes another person’s rights or creates a material security or legal risk.
Provisions concerning intellectual property, liability, privacy and governing law continue to apply after termination where appropriate.
15. Changes to These Terms
We may revise these Terms to reflect changes to our Services, business practices or legal obligations.
We will publish updated Terms with a revised effective date. Continued use after publication constitutes acceptance to the extent permitted by law.
If a material change affects newsletter subscribers, we may also provide notice through the newsletter or website.
16. Governing Law
The laws of the Republic of South Africa govern these Terms.
Any dispute will be subject to the jurisdiction of the competent South African courts, subject to any consumer rights or alternative dispute mechanisms that cannot lawfully be excluded.
